Products
Our items are handmade or handcrafted from natural materials including wood, stoneware, and ceramic. Slight variations in grain, color, glaze, size, and texture are normal and are not defects. Photos are representative, and the item you receive may vary slightly.
Pricing and payment
Prices are listed in U.S. dollars and may change without notice. Payment is due in full at checkout through the payment methods enabled by Shopify.
If a product is listed at an incorrect price due to a typographical, pricing, or system error, we reserve the right to cancel any order placed at the incorrect price, whether or not the order has been confirmed. If we cancel an order for this reason, we will notify you and issue a full refund.
Shipping
Herth Home Products currently ships within the United States. A $10 flat shipping rate applies to orders under $50; orders of $50 or more ship free. Available delivery details are shown at checkout. We are not responsible for delays caused by carriers or events outside our control.
Returns
Eligible returns follow our Returns policy and are subject to a $12 processing fee. We provide a prepaid return label at no additional charge. The processing fee is waived for items damaged, defective, or shipped incorrectly by us. We do not offer exchanges.
Order cancellations
Orders may be canceled or modified only before they ship. Once shipped, the standard return policy applies. Contact us as soon as possible if you need to change or cancel an order.
Acceptable use of the site
You agree not to use this site to violate any law; scrape, crawl, or harvest data from the site using automated tools; interfere with or disrupt the site's operation; or copy, reproduce, or repost our content without permission. We may restrict or terminate access to the site for anyone who violates these Terms.
Reviews and submitted content
If you submit a product review, photo, or other content to us, including through the site, email, or social media, you grant us permission to display and use that content in connection with marketing and selling our products, including on our website, social media, and in advertising. You confirm that you own the content or have the right to share it with us.
Intellectual property
Site content—including product photos, descriptions, logos, and design—is owned by Herth Home Products and may not be copied or used without written permission.
Disclaimer of warranties
To the fullest extent permitted by law, our products and this website are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability or fitness for a particular purpose. This does not affect any statutory rights you may have that cannot be waived under applicable law.
Limitation of liability
To the fullest extent permitted by law, Herth Home Products is not liable for indirect, incidental, or consequential damages arising from use of our products or website. Our total liability for any claim relating to a product or order will not exceed the amount you paid for that product.
Force majeure
We are not responsible for delays or failure to perform our obligations due to causes beyond our reasonable control, including natural disasters, extreme weather, carrier disruptions, supplier delays, or other similar events.
Third-party links
Our site may contain links to other websites, including social media pages, that we do not own or control. We are not responsible for the content, privacy practices, or terms of any third-party site, and including a link does not mean we endorse it.
Indemnification
You agree to indemnify and hold Herth Home Products and APM Distribution LLC harmless from any claims, damages, losses, or expenses, including reasonable attorney's fees, arising from your violation of these Terms or your misuse of the site.
Governing law and venue
These Terms are governed by applicable United States law and the laws of the State of Illinois, without regard to conflict-of-law principles. Any legal action relating to these Terms or the site will be brought in the state or federal courts located in Will County, Illinois, and you consent to jurisdiction and venue there.
Time limit to file claims
Any claim you have arising out of or related to these Terms or your use of the site must be filed within one (1) year after the claim arises, or it will be permanently barred, to the extent permitted by applicable law.
Disputes
If a dispute arises, please contact support@herthhomeproducts.shop first so we can try to resolve it directly and informally. If we're unable to resolve a dispute this way, either party may pursue any remedy available under applicable law, including small claims court where eligible.
Waiver
If we don't enforce a provision of these Terms on one occasion, that does not mean we waive our right to enforce it later.
Severability
If any provision of these Terms is found to be unenforceable, that provision will be removed or limited to the minimum extent necessary, and the remaining provisions will remain in full effect.
Entire agreement
These Terms, together with our Privacy Policy and Returns policy, make up the entire agreement between you and Herth Home Products regarding your use of the site and any purchase.
